What is Ground 13 - Deterioration in the Condition of the Property
The landlord must prove that:
a) The condition of the property or common parts has deteriorated.
This includes damage to the structure, fixtures, or communal areas shared with other tenants.
b) The deterioration was caused by the tenant or a person residing with them.
This includes direct damage, neglect, or failing to take reasonable care of the premises.
c) The deterioration was not caused by a visitor unless it was a lodger or subtenant and the tenant failed to take reasonable steps to evict them.
Damage by guests or one-off visitors is not sufficient unless the tenant bears some responsibility for allowing it to happen.
Possession during fixed term
A possession order can take effect during a fixed term if the tenancy agreement allows it.
Notice period
The minimum notice period the landlord must give under Ground 13 is two weeks.
Reasonable to order possession
Even if the ground is proven, the court must still be satisfied that it is reasonable to make a possession order.
