What is Ground 15 - Deterioration of Furniture
The landlord must prove that:
a) Furniture provided with the tenancy has been damaged by the tenant or someone living in the property.
This includes intentional or negligent damage caused during the tenancy, such as broken beds, sofas, or appliances.
b) If the damage was caused by a lodger or subtenant, the tenant failed to take reasonable steps to remove them.
The landlord must show that the tenant allowed the lodger/subtenant to remain despite knowing about the damage or risk of damage.
Possession during fixed term
An order for possession on Ground 15 can take effect during a fixed term if a term in the tenancy agreement allows it.
Notice period
The minimum notice period the landlord must give under Ground 15 is two weeks.
Reasonable to order possession
Even if the landlord proves the elements of Ground 15, the court must still be satisfied that it is reasonable to make a possession order.
