What is Ground 16 - Employee of the Landlord
The landlord must prove that:
a) The tenancy was originally granted for the tenant's employment with the landlord.
The property must have been let either by the current landlord or a previous one under the same tenancy specifically for the purpose of the tenant’s employment.
b) The tenant’s employment with the landlord has ended.
The employment in connection with which the tenancy was granted must have ceased. The landlord does not need to prove that they now require the property for a new employee.
Possession during fixed term
A possession order cannot take effect during the fixed term of the tenancy.
Notice period
The minimum notice period the landlord must give under Ground 16 is two months.
Reasonable to order possession
Even if the landlord proves both elements of the ground, the court must still be satisfied that it is reasonable to make a possession order.
