What is Ground 7a - Antisocial Behaviour
What must be proved, one of five conditions must apply:
Conviction of a serious offence.
Breach of an injunction.
Breach of a criminal behaviour order.
Closure order.
Noise nuisance conviction.
Time limit to serve notice
Within 12 months (or 3 months for closure order) of conviction or finding.
Possession during fixed term
Allowed if agreement permits.
Minimum notice period that landlord will seek possession using this ground
One month for fixed term.
Four weeks for periodic.
Mandatory Ground
As this is a mandatory ground, if the landlord proves the ground, the court must order possession. There is no power vested in the court to consider ‘reasonableness’ of granting possession in relation to this mandatory ground if the landlord is able to prove the requirements of the Ground.
