What is Ground 9 - Suitable Alternative Accommodation
The landlord must prove that:
a) Suitable alternative accommodation is available, or will be available when the possession order takes effect. This includes housing that meets the tenant's needs, is affordable, and provides similar security of tenure.
b) The court is satisfied the accommodation is genuinely suitable in light of the tenant’s circumstances. This includes location, affordability, environmental factors, and comparable furnishings if the current home is furnished.
c) The accommodation is either being provided by the landlord or confirmed by a certificate from a local authority — which conclusively proves availability and suitability.
d) The tenant is entitled to reasonable removal expenses from the landlord if the order is made.
Possession during fixed term
A possession order cannot take effect during the fixed term of the tenancy.
Notice period
The minimum notice period the landlord must give under Ground 9 is two months.
Reasonable to order possession
Even if the landlord proves that suitable alternative accommodation is available, the court must still be satisfied that it is reasonable to make a possession order.
