What is Ground 14za - Offence During a Riot
The landlord must prove that:
a) The tenant, or an adult living in the property, has been convicted of a serious offence.
The offence must be one triable only in the Crown Court (i.e. indictable only). Less serious offences heard in the Magistrates’ Court do not satisfy this ground.
b) The offence was committed during a riot in the UK.
A “riot” means 12 or more persons who are present together use or threaten unlawful violence for a common purpose, and their conduct would cause a person of reasonable firmness to fear for their personal safety.
Possession during fixed term
An order for possession on ground 14ZA can take effect during the fixed term if the tenancy agreement allows it.
Notice period
The minimum notice period the landlord must give under Ground 14ZA is two weeks.
Reasonable to order possession
Even if the elements of the ground are proved, the court must still be satisfied that it is reasonable to make a possession order.
